Welcome to Alotricity (“we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of the Alotricity website (alotricity.com), our mobile applications, EV charging stations, and related amenities (collectively, the “Services”).
By accessing our website, creating an account, or using our EV charging stations and facilities, you agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use our Services.
1. Acceptance of Terms
By using Alotricity’s website or charging infrastructure, you affirm that you are at least 18 years of age (or possess legal parental/guardian consent) and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.
2. Changes to Terms
We reserve the right to modify, amend, or update these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on alotricity.com. Your continued use of our Services following the posting of revised Terms means that you accept and agree to the changes.
3. User Accounts & Registration
Account Security: To use certain features (such as tracking charging sessions, mobile payments, or accessing member-only lounge perks), you may need to register for an account. You are responsible for maintaining the confidentiality of your account credentials.
Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.
Account Activity: You are solely responsible for all activities that occur under your account.
4. EV Charging Services & Usage Rules
Proper Use: You agree to use Alotricity charging equipment only for its intended purpose—charging compatible electric vehicles using proper connectors and cables.
Idle Times & Overstay Fees: To ensure availability for all drivers, vehicles must be moved promptly once charging is complete. We reserve the right to assess idle fees or overstay charges for vehicles occupying a charging bay after a session has ended.
Safety Compliance: You must follow all posted operating instructions, safety warnings, and local laws while using our charging stations. If you notice any damage or malfunction to a charger, you must stop using it immediately and report it to our customer support.
No Tampering: Any attempt to damage, tamper with, hack, or reverse-engineer Alotricity hardware, software, or network systems is strictly prohibited and will result in immediate termination of service and potential legal action.
5. Station Amenities & Facility Guidelines
Alotricity facilities may feature extra amenities such as lounges, restrooms, private rooms, food services, and Wi-Fi.
Code of Conduct: Users and visitors must behave respectfully. Disruptive, destructive, or unsafe behavior may result in expulsion from the premises and a ban from future use.
Wi-Fi Usage: Free Wi-Fi provided at our locations is subject to acceptable use policies. You agree not to use the network for illegal activities, torrenting, or distributing malware.
6. Fees, Billing, and Payments
Pricing: Rates for electricity (AC/DC charging), subscription packages, or idle fees are displayed via our mobile app, website, or station screens. Prices are subject to change.
Payment Authorization: By initiating a charging session, you authorize Alotricity (or our third-party payment processors) to charge your designated payment method for the cost of electricity consumed, applicable taxes, and any incurred overstay fees.
Refunds: Disputes regarding billing or failed charging sessions must be reported to customer support within 30 days of the transaction. Refunds or credits are issued at Alotricity’s sole discretion.
7. Intellectual Property
All content on alotricity.com, including text, graphics, logos, images, software, and the compilation thereof, is the property of Alotricity or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written consent.
8. Limitation of Liability
Use at Your Own Risk: Your use of our website, charging stations, and physical facilities is at your sole risk.
Vehicle Damage: Alotricity is not responsible for any damage to your vehicle, its battery, or its electrical system unless caused directly by our proven gross negligence or willful misconduct.
Service Interruptions: We do not guarantee uninterrupted, continuous, or error-free operation of our charging stations or website. Chargers may occasionally be out of service due to maintenance, power grid outages, or technical glitches.
Maximum Liability: To the maximum extent permitted by law, Alotricity’s total liability for any claims under these Terms shall not exceed the amount you paid to Alotricity in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Alotricity, its founders, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms, misuse of our charging stations, or negligence/infringement of third-party rights.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Alberta, Canada, without regard to its conflict of law principles.
